Privacy Policy – Terms & Conditions

The terms and conditions set out hereafter govern access to and use of the URL address http://www.aphelium.co.uk  / 194.154.164.100 (also referred to hereinafter as the PORTAL), which is owned by the Center Of International Property Ltd. group of companies (hereinafter APHELIUM).
 
APHELIUM is committed to protecting your privacy when you use our on-line, telephone or other services. In this policy we explain how and why we collect your information, what we do with it and what controls you have over our use of it.
Your acceptance of these Privacy Policy terms - By using any of the sites within our PORTAL network ("http://www.aphelium.co.uk  / 194.154.164.100") or our services, the USER expressly accepts the entire contents of this document, and agrees unconditionally to be bound by this Privacy Policy. If the USER does not accept these General Terms of Use, he or she is to refrain from accessing and/or using the services and/or content offered by APHELIUM.
 

This Privacy Policy governs the general use of the Portal by its USERS. The USERS will be able to view and to print these terms.

The Parties: Identification

APHELIUM: APHELIUM is the trading name for Center of International Property Ltd.
The USER: The individual or legal entity, herein after referred to as THE USER, accessing the website to seek information and to use the services offered through the portal.
The PORTAL:  The website URL address http://www.aphelium.co.uk  / 194.154.164.100

 

The Policy

 

APHELIUM has no control over, and does not guarantee the absence of, viruses and other elements in the Content that may give rise to incidents with the USER’s computer system (software and hardware) or with the electronic documents and files stored in it.


APHELIUM reserves the right to deny or withdraw access to the Portal and/or the Services, at any time and without having to serve prior notice, to USERS who fail to adhere to these General Terms.

Email

The policy of APHELIUM with respect to e-mail is grounded on sending out only communications you have requested. In cases of advertising mailings arranged by  APHELIUM  for USERS, the messages will be marked 'advertising'  to avoid confusion. If you do not wish to receive these messages by e-mail, you will always be offered a simple, straightforward way to state that.

THE USER and APHELIUM undertake to use the Services in accordance with the Unsolicited Advertising Policy, and in particular, they undertake to refrain from sending chains of unsolicited electronic messages.
 
It is very important to us that we provide you with the highest level of service.  In order to help us do this, from time to time APHELIUM companies may send you details of our products and services which we think may be of interest to you.  If at any time you do not wish to receive these details, please e-mail us at unsubscribe@Aphelium.co.uk   

Persons who suffer the dispatch of unsolicited advertising messages addressed to a number of people can notify APHELIUM of this by sending a message to the e-mail account: abuse@Aphelium.co.uk 

Changes

APHELIUM  reserves the right to change or remove the content, services and information on the website at any time and without prior notice, and also to limit or cancel the general terms and conditions applicable to the website.
 

The Purpose’s of the Services Offered 
 

APHELIUM  is a commercial company whose main activity is the production, distribution and marketing of real estate projects.
 

Through its PORTAL, the company offers information about its activities, its projects and its group of companies, and it also provides various services of interest to professionals and private individuals alike. 
 

Through its PORTAL, APHELIUM enables USERS to access and use the various services and content made available to them by the company itself and/or by third parties.

Conditions for Accessing and using the Portal 
 

The Portal can be visited by any USER at will and at no charge, provided that it is accessed solely for his or her personal use. However, for the purpose of rendering certain services through the website, USERS will be required to fill in a form to give the data and information requested in the forms, and if a USER does not fill in all the fields that are marked with an asterisk to show their compulsory nature, APHELIUM reserves the right not to render the service concerned. The USER guarantees the authenticity of the data he or she provides, and he or she shall be solely responsible for any false or inaccurate statements.
 
Within APHELIUM your personal Data will be transmitted and stored in a protected environment (e.g. protected by firewalls). We undertake to take all reasonable steps in order not to allow your personal Data to be seen by any third parties other than those which have been engaged by APHELIUM to provide services to you.
 
We may store Data in locations other than your country of residence. In such cases APHELIUM will endeavour to ensure that there are adequate levels of protection for your Data taking into account applicable legal and regulatory requirements. 
 

What data do we collect and how do we use it?

You may be asked, either when you register with us, or at other times, for information about yourself, such as your name, e-mail address, postal address and telephone number.  You may also be asked to share with us your interests, hobbies and preferences.
APHELIUM collects and processes information about you in order to:
 

  1. identify you each time you visit a website or wish to have a Service provided;
  2. process orders or applications submitted by you;
  3. improve our Services and websites
  4. customise your experience, for example, provide advertisements that we think are relevant to you and which support any specific requests for information you may make through keyword searches;
  5. carry out research on the demographics, interests and behaviour of all of our customers; and
  6. send you information we think you may find useful, including information about new APHELIUM products and services. 

You are under no obligation to provide this information, but if you don't then we may not be able to provide you with certain services or personalise your experience and tailor our Services for you (for example, tell you about special offers on things you're interested in).

Where is the information stored?

Information which you submit via our PORTAL or our telephone services is stored on a computer located in the European Economic Area.  This is necessary in order to process the information and to send you any information you have requested.  Information submitted by you may be transferred by us to our other offices and to reputable third party suppliers, which may be situated outside the European Economic Area.  Not all countries outside the EEA have data protection or privacy laws.  In addition, if you use our Services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those Services.

Technical requirements for access

To access the PORTAL, USERS must have access to the Internet, pay the pertinent access and connection fees, and have all the computer systems and equipment required for connecting to the Internet, including a terminal that is suitable for the purpose (a PC or compatible computer, a telephone etc.) and a modem or other such access device. Accessing and using certain contents and services in the PORTAL properly entails downloading certain computer programs or other logic elements into the USERS' computer systems; such installation is the responsibility of the USER, APHELIUM is declining all liability for any consequences resulting from this. In this context, the USER will need to have a bandwidth of at least 256 Kb/s available for accessing certain multimedia content, APHELIUM declining any responsibility for poor running of the multimedia content due to fluctuations in the bandwidth of the USER'S Internet connection.

Responsibility

APHELIUM declines all direct and subsidiary responsibility for:
 

  1. The PORTAL’S quality of the service, speed of access, proper functioning, and its availability and continued functioning.
  2. Information added by USERS, contributors and third parties.
  3. Any damage done to the USERS’ equipment through using the PORTAL.  
  4. Transgressions of the law, moral standards, generally accepted standards of conduct, or public order as a result of the transmission, dissemination, storage, provision, reception and obtaining of the content or accessing it.
  5. Infringements of intellectual and industrial property rights, rights to honour, rights to privacy for individuals and families, rights to personal image (photographs), property rights and rights of all kinds belonging to a third party, as a result of the transmission, dissemination, storage, provision, reception or obtaining of the content or accessing it.
  6. Links and hypertext (such as links, banners or buttons) enabling USERS to access other websites, facilities and services offered by third parties via the PORTAL, do not belong to and are not under the control of  APHELIUM , the latter declining responsibility for the information they contain and for any effects that may stem from that information.

 
APHELIUM declines all direct, subsidiaries, explicit or implicit responsibility for any flaws or defects of any kind in the content transmitted, disseminated, stored or made available, for any out-of-date or inaccurate elements in that content, and for its scientific quality, as applicable.
 
APHELIUM declines all responsibility, in the terms set down above, for any decisions taken by USERS as a result of replies made to their queries.
APHELIUM declines all responsibility for the carrying out of any action which is illicit, counter to rights, harmful and/or damaging.
 

The USER undertakes to use the PORTAL, the Services and the Content in accordance with the law, moral standards, general standards of behaviour, public order, and these terms and conditions. He or she undertakes to use the PORTAL, the Services and the Content in a diligent, proper and lawful manner, and particular undertakes to refrain from:
 

  1. Reproducing or copying, distributing, permitting public access through any form of public communication, transforming or modifying the Content, unless authorisation has been issued by the holder of the pertinent rights or unless such acts are legally permissible.
  2. Removing, evading or tampering with the "copyright" and other data identifying the rights of the owners of content incorporated in the Content, this applying also to the technical protection systems and any other information mechanisms that may be contained in the Content.  
  3. Using the forums made available by APHELIUM for posting messages that bear no direct relation to the topics of the forum, and in particular posting content that is illegal, illicit, slanderous or liable in any way to run counter to the rights of third parties or to damage computer systems.  APHELIUM reserves the right to remove any message it deems inappropriate.

 
If USERS are given passwords by  APHELIUM  for the purpose of accessing certain parts or services of the website, they shall undertake to keep custody of them diligently, to keep them secret, and to accept responsibility for any economic consequences or damages resulting from failing to show due diligence in their custody

Intellectual and Industrial Property

The PORTAL in its entirety - text, images, marks, graphics, logos, buttons, software files, combinations of colours, and the structure, selection, ordering and presentation of its content - is protected by the legislation on intellectual and industrial property, it being forbidden to reproduce, distribute, publicly disseminate or transform it, except for personal private use.
 
It is also forbidden to reproduce, relay, copy, assign or broadcast, in whole or in part, the information contained in this PORTAL, for whatever purpose and by whatever means.
 
In accepting these terms, USERS adding reviews or comments to the PORTAL accept granting to APHELIUM the right, as a right that is non-exclusive, royalty-free, perpetual, irrevocable and fully assignable to third parties, to use, reproduce, modify, adapt, publish, translate, use for creating derivative projects, distribute and exhibit those reviews and comments anywhere in the world and through any means of communication. Those USERS shall also grant APHELIUM the right to use any name accompanying such reviews or comments, if there is one, in connection with said reviews or comments.

No link to the PORTAL may be added in any other website without the prior express consent of APHELIUM.

Use of Cookies

Cookies are pieces of information that a website transfers to your hard drive to store and sometimes track information about you.  Most web browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that.  However, you may not be able to take full advantage of a website if you do so.  Cookies are specific to the server that created them and cannot be accessed by other servers, which means they cannot be used to track your movements around the web.  Although they do identify a user's computer, cookies do not personally identify customers or passwords.  Credit card information is not stored in cookies.We use cookies for the following reasons:

 With whom is the information shared?

APHELIUM will not share, sell or rent your personal information to third parties.  However, we may disclose your personal information to third party suppliers who provide services on our behalf.

APHELIUM may disclose aggregate statistics about our sales, our PORTAL visitors and customers of our telephone services in order to describe our services to prospective partners, advertisers and other reputable third parties and for other lawful purposes, but these statistics will not include personally identifying information.

APHELIUM may disclose personal information if required to do so by law or if it believes that such action is necessary to protect and defend the rights, property or personal safety of company name and its PORTAL, visitors to the PORTAL and customers of our Services.

Our PORTAL contains links to the sites of third parties.  When you visit these sites, we suggest that you read their privacy policies. APHELIUM is not responsible for the privacy policies or the content of such sites.
We will only sell or rent your personal information to a third party either as part of a sale of the assets of a APHELIUM or having ensured that steps have been taken to ensure that your privacy rights continue to be protected.
Security
 

APHELIUM places a great importance on the security of all information associated with our customers. We have security measures in place to attempt to protect against the loss, misuse and alteration of customer data under our control.  For example, our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to user information. With regard to our PORTAL, we use secure server software (SSL) to encrypt financial information you input before it is sent to us.  While we cannot ensure or guarantee that loss, misuse or alteration of data will not occur, we use our best efforts to prevent this.

Jurisdiction


It is your responsibility to ensure that your use of the PORTAL is not contrary to the laws of your country of residence.
